Family allowance in Peru: how much is it, who receives it and how is it paid?

Which workers receive family allowance?

As established in the Law No. 25129the family allowance is a social benefit that is paid separately and that corresponds to workers who work formally (on payroll) in the private sphere, whose salary is not regulated by collective bargaining and who have children under 18 years old or, in any case, are of legal age, as long as they are studying higher education, with which this subscription is extended up to 24 years of age.

How much should I receive as a family allowance?

The amount to be received for household allowance It is equivalent to 10% of the minimum vital remuneration that currently amounts to S/1,025. For this reason, workers who meet the requirements to access this benefit must receive S/102.50 in addition to their salary. Along the same lines, it is necessary to indicate that this amount is not subject to discounts of any kind, nor is it subject to the number of days worked.

What happens if the employer does not pay the family allowance?

Given that the family allowance is a right that corresponds to the formal workers of the private sectornot paying it would consist of a serious offense on the part of the employer, as established in article 24.4 of Supreme Decree No. 019-2006-TRwhich would make him deserving of a sanction.
