Closure of the San Marcos stadium: concert organizers must communicate measures to consumers

On September 3, the Municipality of Lima established the closure of the San Marcos stadium for 60 days after repeated complaints from students and neighbors about the loud noises from the concerts.

Despite this temporary closure, there are several concerts that are already scheduled for the next two months. Faced with this situation, the National Institute for the Defense of Competition and the Protection of Intellectual Property (Indecopi) has urged the companies in charge of organizing these events to notify consumers about the measures they will take in case of possible postponements or cancellations.

Likewise, these companies have to inform about their return policy when an event is canceled and notify consumers in advance of the cancellation, postponement or other measure related to the events they are responsible for.

If you do not comply with the provisions, the decision-making bodies could initiate a sanctioning procedure and even fine these companies with up to S/2 million (450 UIT).

What should the user consider?

In the event that a concert is postponed, consumers have the option to accept the new date or request a refund of their tickets. In the event of a cancellation, the organizing companies are obliged to refund the money within a reasonable time and according to the previously communicated schedule. In addition, they must have available to consumers a service channel for complaints and inquiries that is in operation.

It should be noted that, if their rights are violated, consumers can present their claim in the claims book of the organizing company. This must respond to you within a maximum period of 15 non-extendable business days.

What concerts were scheduled at the San Marcos stadium?

For the next few months, several concerts are scheduled. The presentation of the metal band Manowar stands out, scheduled for September 14 on their first visit to Peru. Likewise, the celebration of the 47th anniversary of Agua Marina was expected on September 29. Likewise, the American singer The Weeknd had his tour “The After Hours Tour” scheduled with a presentation scheduled for Sunday, October 22, and Rauw Alejandro had a concert scheduled for Saturday, October 28.
