Katty Ugarte, congresswoman for Parliamentary Unity and Dialogue, has presented the Bill 5813/2023-CRwhich seeks to modify article 59 of Law No. 29571 of the Consumer Protection Code in order to strengthen the right of restitution of users.
The initiative proposes that Clients can exercise the right to restitution or refund of all benefits that they have paid when their rights are violated due to to aggressive or deceptive methods, without the need to submit supporting documents that demonstrate the consumer relationship, such as bills or invoices.
In this way, people may request the reimbursement of the consumption or service, as well as the termination of the contract only with their ID or RUC in the event of negligence or infractions of consumer law. In this sense, the supplier must have the contract record in its internal system.
How would the law be established after the modification?
Thus, article 59 of the Consumer Protection Code would be worded as follows:
“Article 59.- Right to restitution The consumer has the right to immediate restitution of the services that are the subject of the consumer contract in those cases in which the provider has incurred in any of the practices indicated in article 58, whatever the modality of hiring employee.
To exercise the right to restitution, it is not mandatory to present any supporting document that proves the consumer relationship, since it is the provider’s obligation to have said contract registered in its internal and tax system, it being sufficient to prove the ownership of the DNI or RUC in the contracting the product or service, as appropriate. The requirement of a supporting document on the part of the supplier to exercise the right of restitution is considered a very serious offense.”
