This Wednesday, August 30, Peruvians will enjoy a new holiday in our national calendar to commemorate Santa Rosa de Lima, patron saint of America and the Philippines. Like every year, many people take advantage of the date to travel and share a moment of fun with their family or friends. However, there are workers from the private regime who work on this day and, in this note, we invite you to find out what amount they are entitled to receive.
Holiday August 30: how much should I be paid if I work on this day?
According to the National Superintendence of Labor Inspection (Sunafil), Private sector workers who work on August 30 and do not agree with the employer on a substitute rest date, must receive a triple payment which is configured as follows:
- A salary for the holiday.
- A remuneration for the work done (already included in the remuneration).
- A surcharge of 100% for working on holidays without rest.
August 30: how to calculate the payment of the holiday worked?
To understand how much you are paid if you work on the August 30 holiday, the Lima Chamber of Commerce (CCL) explains it through the following example:
If the monthly remuneration of a worker is equivalent to the minimum wage of S/1,025, the corresponding daily amount is S/34.17, after dividing his salary by 30 days. In this sense, your payment must consider the sum of the 3 amounts mentioned above.
- For the holiday that is already considered in your monthly salary, it is equivalent to S/34.17
- For the work done that day, the respective amount is S/34.17
- For the surcharge of 100% of the daily remuneration it is S/34.17.
Finally, the worker will receive a total of S/1,093.34 on his pay slip for the month. Then, adding the corresponding S/68.34 for working on those days.
Holiday August 30: what happens if I don’t get paid triple salary for working on this day?
According to the information provided by Sunafil, failure to pay those who work during the August 30 holiday constitutes a very serious offense that can be punished with a fine between S/1,138.50 and up to S/260,023.50, depending the number of workers affected. Next, these are the fines:
- In the case of a microenterprise, the fine ranges from between S/ 1,138.50 and S/ 3,366.
- If it’s a small business, the fine ranges from S/ 3,811.50 to S/ 37,867.50.
- If it is not an SME, the fine ranges from S/ 13,018.50 to S/ 260,023.50.
