Only 1,854 public workers went to the Servir regime

In 2013, the Executive Power promulgated the Law 30057which creates the civil service, a new regime for people who provide services in the State and which guarantees the labor rights of public servants.

The objective of this measure was for state entities achieve higher levels of effectiveness and efficiency. However, 10 years after the creation of this regime, the results have been very limited.

The Government itself has recognized that there is little progress in the reform of the civil service.

Ana Paripresident of the National Civil Service Authority (Servir), in dialogue with La República, pointed out that, of the approximately 3,000 public entities, only 513 have carried out actions related to the transition process to said regime.

Even of these 513 institutions, only 15 have managed to complete the transition phase towards the civil service and already have their Table of Entity Positions (CPE). In addition, of this small group, only 10 public entities have been able to incorporate personnel through the new regime, through a public tender.

In this way, in 10 years of implementation of the civil service, only 1,854 public workers belong to the Servir regime. This, from a universe of more than half a million state-owned that could be incorporated.

This meager progress has been questioned by the Federation of Workers of the National System of Public Records (FETRASINARP), who point out that there is a design problem.

“In the 10 years since the legal framework was in place, it would have been possible for an average of 100 workers per year to transition to the new regime. This result is a clear example of the serious problems not only in the implementation of the regime, but mainly in its design,” the union said.

Main problems

The Executive Power has detected several obstacles that prevent the advance of the Servir regime. One of them is that the transfer is voluntary; that is to say, the transition of the entities and their personnel to the civil service today is at the will of the authorities on duty. In addition, the process for the institution to migrate is complex, which means that this process takes up to three years.

For this reason, in the draft of legislative powers, the Executive will also seek to promote measures that allow this process to be accelerated.

Pari anticipates that the directives will be updated so that only the essential requirements are requested from the entity. In addition, that mandatory deadlines will be established so that transit is a priority in the authorities.

“In order for it to be prioritized, there must be a mandatory term and not only be a voluntary or discretionary matter of the entity holders, in such a way that, by identifying the essential requirements and with a mandatory term, the authority in charge is obliged to allocate the respective professionals of his entity so that they meet the requirements and finally transit, ”Pari told this outlet.

The administrative contracting of services (CAS) has also been an obstacle to progress, since entities that are or are not in the Servir regime can continue hiring CAS personnel; therefore, they opt for this mechanism, which allows them to define job profiles and remuneration at their discretion.

Likewise, the existence of various labor regimes has slowed down the Civil Service. Despite the fact that Law 30057 was created so that there is order in the State, the Government acknowledges that “the corresponding mechanisms and incentives were not established so that the personnel of the Legislative Decree 276, Legislative Decree 728 and CAS transition to the civil service regime. Said diversity of labor regimes has accentuated the different treatment of public servants, expanding the perceived discrimination between them”, underlines the Executive Power in its Bill 5632.

Greater equal pay

The president of Servir explains that the civil service seeks to have greater salary equality in the public sector, since currently in an entity you can find various workers performing similar functions, but with different salaries, because there is no remuneration scale.

“There is equal pay because the remuneration will be established by the compensation regulations, according to the profile that includes experience and a minimum academic profile,” Ana Pari told this outlet.
