The Superintendency of Banking, Insurance and AFP (SBS) declared the dissolution of 11 savings and credit cooperatives at the national level for being involved in causes of inactivity.
These are the cooperatives Sol de Arequipa Limitada, Progremos Unidos, Sol Naciente, Finanzas el Metro, Del Norteño, Credifinca, Crecer Family, Coopesur, Ancash, Alto Chicama, and Raíces Limitada.
According to the regulations of the SBS, as of this date, it is prohibited to initiate judicial or administrative processes against these cooperatives for the collection of receivables under their responsibility, or pursue the execution of judicial decisions issued against them.
Neither may liens be constituted on any of her assets as collateral for the obligations that concern her, or make payments, advances or compensation, or assume obligations on her behalf, with the funds or assets that belong to her and are in the possession of third parties, or constitute a precautionary measure against her assets.
The SBS will designate temporary administrators who will be empowered to carry out the acts of dissolution. These powers include issuing invitations to conciliate, participating as guests in conciliation processes.
In the same way, temporary administrators may participate in conciliation hearings and reach out-of-court conciliation agreements, understanding therefore that said representatives have the necessary powers to conciliate out-of-court and dispose of the rights subject to conciliation.
