Bonus 2023: can my employer discount this money?

In the next few days, the deadline for private companies to deposit the bonus for National Holidays expires. At the latest, the deposit must be made on Saturday, July 15.

The amount of the bonus must be equivalent to a full monthly remuneration if the worker worked the entire semester, that is, from January 1 to June 30. However, for those persons who did not practice during the entire period, the amount of the gratification will be in proportion to the number of calendar months in which they were in activity.

For example, if a person started work on March 3, 2023, the month of March will not be included in the calculation because the full calendar month was not worked.

It should be noted that, in addition to the payment of the gratificationthe employer must pay an extraordinary bonus equivalent to 9% of the contribution to Social Health Security. In the case of workers covered by a Health Provider Entity (EPS), said extraordinary bonus would be equivalent to 6.75%.

Can my employer deduct this money?

The National Superintendence of Labor Inspection (Sunafil) reported that the bonus for National Holidays should not be affected by contributions, contributions or discounts by the employer, except for those established by law, court order or authorized by the worker himself.

Non-compliance with the payment of the gratuity is classified as a serious infraction in matters of labor relations.

Although the sanction is determined according to the number of workers affected and the type of company, the fines range from S/2,227.50 to S/22,275 for a small company and from S/7,771.50 to S/129,294 for a non-mype.
