In accordance with Law No. 31188, which regulates collective bargaining in the State, Public entities and representatives of civil servant unions have until this Saturday, July 15, to negotiate economic agreements and working conditions, reported the National Civil Service Authority (Serve).
The agreements reached between the public unions and the various state entities take place within the framework of collective bargaining at a decentralized level. In this regard, negotiable matters with an economic impact should not coincide with the commitments already agreed at the centralized level, such as the salary increase for 2024 of S/100 in two tranches for the staff and the delivery of a extraordinary bonus of S/600 which will take effect this year.
Fernando Cuadros, former Vice Minister of Employment, told The Republic that, although an increase in remuneration or a bonus with the same characteristics cannot be agreed, “other economic improvements such as a productivity bonus” can be negotiated.
“Law no. 31188 establishes the collective bargaining procedure in the state sector, where the terms, stages and rules are established for the correct development of the subscription of the collective agreement that will allow improving the conditions of public servants; without this implies an affectation to the budgetary balance of the Public Administration, consistent with the principle of forecasting and budgetary provision ”, they explained from Serve.
It is important to mention that centralized collective bargaining is carried out in a single process, with the majority representation of the employees of the entities included in the standard, regardless of their employment status. As for the decentralized, it is carried out at the sectoral, territorial level, and by public entity, or in whichever trade union organizations deem appropriate; In addition, the consensus applies only in the sector that corresponds to its celebration.
