The gratification is the additional remuneration received by private sector workers twice a year, on National Holidays and Christmas. Thus, more than four million subordinate employees of the private activity with an indefinite, fixed-term or part-time contract must receive the additional amount corresponding to a full salary until the fortnight of July. Similarly, members of EsSalud will also receive an extraordinary bonus of 9%, while members of a health provider company (EPS) will have one of 6.75%.
To calculate the gratuity it is important to take into account the requirements. In the first place, according to Law 27735, a collaborator, to receive it, must have at least one full month in the company, prior to the month in which the payment of the bonus is deposited. Likewise, you must be working during the first half of July.
In this line, the National Superintendence of Labor Inspection (Sunafil) also indicates that, for the amount to be equivalent to a full monthly remuneration, the worker must have worked the entire semester from July 1 to December 31. If this condition is not met, the balance will be equivalent to 1/6 of the salary, computable for each month worked.
It should be noted that, within the computable remuneration, the one received by the collaborator on a monthly basis, variable concepts are included, such as bonuses, commissions, etc.; these will be variables within the bonus calculation if the employee has received them for at least three months in the semester, said Jimmy Huatuco, head of Buk Peru Projects.
Where can I calculate my bonus?
Users can calculate their bonus through the Sunafil labor calculator or through La República.
What is truncated gratification and to whom does it belong?
When a person ends their employment relationship and has completed at least one full month of service, they are entitled to receive the truncated bonus. This benefit is calculated proportionally to the calendar months worked from January 2023 to the termination date.
The remuneration considered for the payment of this gratuity is the one in force in the month prior to termination and is delivered together with the social benefits within 48 hours after the end of employment.
