MTC publishes draft law regulation for the removal of disused aerial cables

He Ministry of Transport and Communications (MTC) published a project of the regulation of the Law that promotes environmental decontamination and establishes the removal of aerial wiring in disuse or in poor condition in urban areas, in order to receive comments.

Ministerial Resolution No. 839-2023-MTC/01 is disclosed for the purpose of receiving the opinions, comments and/or suggestions of the public, within a period of 10 business days from the day after the publication of the measure in the official newspaper El Peruano.

The regulation is published in compliance with Law No. 31595, a Law that promotes environmental decontamination and establishes the removal of disused or in poor condition aerial wiring in urban areas of the country, issued in October 2022.

This device establishes environmental decontamination through the removal of overhead wiring from electricity and telecommunications services that are in disuse or in poor condition in urban areas of the country, in order to guarantee the safety of the population and the right to live. in a healthy and balanced environment.

The Ministry of Transport and Communications has coordinated with the Ministry of Energy and Mines, the Ministry of the Environment and the Agency for Environmental Evaluation and Control (OEFA), with whom a draft regulation has been prepared.

“It is necessary to establish the provisions for the development of Law 31595, so that the concessionary companies of electricity, telecommunications and passive infrastructure providers can carry out the activities of identification and removal of disused or in poor condition aerial wiring networks. state, electricity and telecommunications services, in the country’s urban areas,” the document states.
