He Executive power promulgated the norm that modifies Law 31557 that regulates the exploitation of remote games and sports betting at a distance and the sanctions for those who operate these games without authorization.
The new provision modifies articles 3, 7, 8, 11, 12, 13, 15, 22, 24, 26, 29, 31, 38 and 40, and the first and seventh final complementary provisions of Law 31557, Law that regulates the exploitation of remote games and remote sports betting
In this way, it is established that the exploitation of the technological platform for remote games or sports betting must be carried out through the use of domains with the extensions “.bet.pe”, “.bet”, “.com”, “.pe” or “.com.pe” obtained from an entity responsible for granting such extensions. In addition, it is required to have the corresponding authorizations granted by the Ministry of Foreign Trade and Tourism (Mincetur).
Besides, It is indicated that the technological platforms for remote games or sports betting, game programs, progressive systems and main components and/or services must obtain authorization and registration in accordance with the requirements established in the regulations of this law. Likewise, they require a Certificate of Compliance issued by authorized certification laboratories, which guarantees compliance with the established technical standards.
In addition, it is stipulated that the authorizations of these sites have an indefinite period of validity.
Regarding the conditions of the bet, it is specified that the technological platforms of distance sports betting can only be bet on those sporting events that are part of associations, federations or national or international sports leagues.
The use of progressive systems is also allowed on technology platforms for remote gaming and remote sports betting, with prior authorization from Mincetur and its corresponding registration.
In what corresponds to the amount of the guarantee granted by the authorization to operate games or sports bets at a distance, it is indicated that the figure between 3% of the annual net income or 600 current UIT is owed. In addition, the difference between the annual gross income and the total amount of returns and prizes delivered in the fiscal year is taken into account.
Finally, the rule modifies article 243-C of the Penal Code, approved by Legislative Decree 635, in such a way that The illegal operation of remote casino games, slot machines and sports betting will be sanctioned with a custodial sentence of not less than one year nor more than four years. with a three hundred and sixty-five day fine and disqualification from carrying out said activity, in accordance with subparagraph 4) of article 36 of the Penal Code.
The aforementioned law will enter into force 120 days after the publication in the official newspaper El Peruano of the supreme decree that approves its Regulations.
