In the context of Farmer’s Day, the National Superintendence of Labor Inspection (Sunafil) reminds employers in the agricultural and agro-industrial sector that workers under the agricultural labor regime have the right to receive a “Special bonus for agricultural work (BETA)”, equivalent to 30% of the Minimum Vital Remuneration (RMV), which exceeds S/300.
Likewise, said bonus is not considered as part of the remuneration and is not included in the calculation of social benefits. In addition, they are entitled to receive a family allowance equivalent to 10% of the RMV, that is, S/102, which is paid proportionally to the corresponding days. In this line, they have the right to participate in the company’s profits.
Those who are included in the agricultural labor regime are those who mainly carry out agro-industrial cultivation or breeding activities, established in DS No 006-2023-MIDAGRI, outside the province of Lima and the Constitutional Province of Callao. It also corresponds to producers organized in associations, as long as each individual associate exceeds five hectares of production, as well as agro-industrial activities related to the cultivation of oil palm and heart of palm.
It should be noted that Sunafil advises that the working day is 8 hours a day or 48 hours a week. If it is exceeded, it is considered overtime and must be paid. Daily Compensation (RD) is calculated by adding base salary, bonuses, and compensation for length of service, and then divided by thirty (30).
