In Peru there are 1770 works paralyzed for more than 12,000 million solesand with a new strategic model, which will be fine-tuned by professional experts from various branches of knowledge, an attempt will be made to put an end to the sad spectacle of infrastructure projects turned into “white elephants”.
It’s about the Dispute Resolution Board (JRD), whose application is mandatory in public works contracts greater than 20 million soles since its implementation in January 2020. This mechanism, since it came into force, has made it possible to unlock infrastructure projects in just 90 days, in contrast to what happened with the arbitration system that takes four years, making the cost of works more expensive and causing losses of billions of soles. .
The president of the Peruvian Consulting Association (APC), engineer Elías Tapia, explained that the function of the JRD is to solve controversies that may arise during the execution of the work, almost in real time, since it is a fast, accurate and effective. “Arbitration has collapsed and that is why the new system was implemented in the State Procurement Law,” he pointed out.
He stressed that the Dispute Resolution Board facilitates the continuity of the work so that we do not have hospital, highway and school construction projects paralyzed for years.
Tapia Julca said that for all these considerations, the APC and the School of Digital Construction promote the holding of the First National Congress of the Public Works Dispute Resolution Board, to be held on June 17 at the Convention Center of the College of Engineers of the Peru, in order to deepen the study and debate of said norm, which has made it possible to make infrastructure projects more flexible and unlock at the level of execution of works.
During the congress, a panel of experts will analyze and propose solutions to optimize this mechanism. All contributions will be forwarded to both the Legislative and Executive authorities to make the necessary improvements.
