Waiters would keep 100% of the tips they receive, according to a bill from Congress

Congresswoman Katy Ugarte Mamani (not grouped) proposes that 100% of the money collected for concepts of consumption surcharge (RC) and tips are directed only to the workers of lodging establishments or restaurants, and it will be considered additional to the remuneration and labor benefits. The objective is to promote better working conditions, and contribute to the social and economic progress of employees.

Bill 5173, presented on Thursday, May 25, specifies that the payment of these amounts will be made by agreement of both parties, but may not exceed 30 calendar days. Meanwhile, if the worker carried out his activities for a shorter period, a proportional amount will correspond to him.

In addition, establishments they are obliged to make transparent the amounts collected by RC and tips both to their workers and to the Ministry of Labor and Employment Promotion (MTPE) and the National Superintendence of Labor Inspection (Sunafil).

“Both the consumption surcharge and the tips are in charge of the consumers, whose amounts, it is understood, should be for the workers; however, in the country it is not alien to hear of news about restaurants that do not distribute the total of this money (…), thus, The need arises to establish a regulatory framework that regulates that both the consumption surcharge as well as the tips, which are voluntary, are destined 100% and only to the workers”is stated in the document.

Likewise, it is ordered that businesses that opt ​​for the collection of RC, which according to current regulations must not exceed 13% of the total of the account, must inform users prior to consumption using a notice in a place visible. If the initiative is approved, the Executive would have a maximum period of 30 calendar days to approve the regulatory provisions, while any breach by the employer may be reported anonymously to Sunafil.

The proposal must be evaluated by the commissions of the Congress of the Republic before reaching the Plenary for debate and voting.
