However, this situation could change with the approval of a legislative decree by the Ministry of Housing, Construction and Sanitation (MVCS). This establishes the creation of a list of delinquent neighbors in the payment of maintenance and fines, that will be linked to the risk centers.

According to the Vice Minister of Housing and Urban Planning, Hernán Navarro, a series of reasons have been identified that generate the need to implement a law related to problems of coexistence. “For example, annoying noises, failure to pay fees, respect for common spaces, among others,” he said in an interview with RPP.

“What is wanted is to create the national registry of debtors and that the board of owners can define in its regulations that if a neighbor does not pay his maintenance fee, he can be sent to this registry of delinquents and reported to risk centers”, explained.

Regulations of the board of owners without legal support

Navarro said that the law intends to give tools to the owners’ meeting to enforce its own internal regulations that to date lack legal support. To do this, they must update a legislation that dates from 1999 on property in buildings and condominiums, and “that over the years, there have been many changes in terms of how cities have grown.”

According to the MVCS official, each Owner board It will establish its own rules of the game, and if they are not complied with, a delay or penalty will be charged and then go to the national registry of defaulters.

Since when would it rule?

But, for the law to begin to govern, it must first be regulated. According to Navarro, the DL gives them a term of up to 180 days, so they calculate to approve it in August. “We are making an effort to have it ready in a maximum of three months,” he said.

What will the regulation establish? It includes all the forms of formation of a meeting of owners, minimum conditions and a series of useful documents. However, the vice minister pointed out that in order to be eligible for the benefits, the neighborhood association must be formalized and registered with the National Superintendency of Public Records (Sunarp).

“We are going to put the important criteria that are required for coexistence, but we are very careful not to establish ranges or values ​​(fines) because that depends on each case. Each condominium has its particularity,” he stressed.
