The decree laws signed by the President of the Republic, Guillermo Lasso, during this period in which he will rule without the intervention of the National Assembly will be framed exclusively in economic matters, as determined by Article 148 of the Constitution.

After the dissolution of the National Assembly, as decided by President Lasso on May 17, Article 148 of the Political Charter allows him to administer legal decrees on the state of economic emergency that must first be reviewed by the Constitutional Court (CC) to qualify their constitutionality.

In this sense, the government minister, Henry Cucalón, clarified this Wednesday, May 17, that the Constitution determines that decrees are only for urgent economic situations and that they should be limited to that issue.

“They should always be in that legislation. They should be limited to economic issues. The court must make a decision on the constitutionality of economic projects. For example, we could not present penal reforms,” ​​said Cucalón in press statements.

The minister explained that President Lasso’s decision to dissolve the National Assembly was due to a “sense of opportunity and convenience” that was motivated by Decree 741.

He repeated that this act of government is protected by the Constitution and “is protected by the legal system”.

And this despite the constitutional appeals that arrive at the seat of the Constitutional Court challenging the dissolution decision.

“To present the resources and requirements that must be channeled through the country’s institutions. “Early elections must be called within seven days, and it would be logical for political actors to present their proposals to show that their alternatives are better,” he said.

Cucalón pointed to the former members of the assembly who until this Tuesday, May 17, occupied a seat in the parliament as “Ecuador’s number one public enemy who entered into this conspiracy for five months. They generated such a level of chaos because they never cared about the country, creating a cloak of impunity.”

Faced with the implications of this presidential measure in the economic sphere, Cucalón asserted that the former legislators “never cared about the country, but preferred to satisfy personal vendettas. They never cared about the economy. But when it is consolidated, there will be a lot of certainty,” he said.

After the dissolution of the Assembly, the National Electoral Council (CNE) must call national elections for the election of representatives and the President of the Republic for the remainder of the period. That is, until May 2025.

In this way, the pending legislative issues will be resolved in the new Assembly, which will be established after these elections. In that area, according to Cucalón, the ratification of the trade agreement with China must wait for the declaration of the new National Assembly.

Cucalón said that during this Wednesday the government held regular meetings with its cabinet and the diplomatic corps accredited in Ecuador and ruled out that ministerial changes were being considered for now.
