MEF: Ruling of the Constitutional Court will allow to pay the debt to fonavistas

This Tuesday, May 2, the head of the Ministry of Economy and Finance (MEF)Alex Contreras, affirmed that now that the Constitutional Court (TC) has ruled on the amount of the debt owed to the ex-contributors to the National Housing Fund (Fonavi), it will be possible to proceed with the return of the money.

“Since the issue has already been defined, it is important that you begin to pay. We are going to coordinate with the ad hoc commission to correct some legal aspects, so that this process can begin as quickly as possible”said the minister.

In March, the Constitutional Court (TC) resolved by majority the claim of unconstitutionality filed by the Executive Power against the Congress of the Republic in relation to the Law 31173. With the decision of the magistrates, the debt that amounts to more than S/42,000 million according to MEF calculations, will now be only S/6,000 millionsince only the contributions of the workers are considered, but not of the employers.

The minister also recalled that the ad hoc commission has resources in its accounts that amount to more than S/1,908 million, while there are additional S/50 million from this year’s public budget that will be allocated with the aim of paying off the debt. .

It should be noted that the Fonavistas do not agree with the ruling of the CT which reduces the State debt by 90%, for which they are preparing legal actions to reverse said decision.

“We have agreed that on Thursday, May 11, we are going to make the coordination to be able to formulate the legal regulations that allow prosecuting the procedure that in some way It has been impacted by the latest judgment of the Constitutional Court since it has created a kind of disarticulation in the process and it is necessary to articulate it again through regulations”said the president of the ad hoc commission, Luis Luzuriaga, through the official social networks of the National Federation of Fonavistas and Pensioners of Peru (FENAF).
