Non-working day 2023 in Peru: see how much you should be paid if you work on Friday, April 28

This Friday, April 28, all workers Peruvians could benefit from a new festive bridge that allows them to rest four days in a row, as happened in Easter. For what is this? It turns out that the Executive decreed this date as a non-working day—mandatory in the public sector but optional in the private sector—in order to promote the tourism intern until Monday, May 1 (Labor Day holiday). The question that many ask themselves is what happens if they work this April 28, do they receive pay triple? We explain them below.

What are the non-working days in 2023?

Before that, we will review the non-working days in the public sector that govern from this 2023 until the beginning of 2024, in accordance with the supreme decree No. 151-2022-PCM:

It should be noted that the hours not worked during non-working days must be compensated within 10 days immediately after or at the time established by the head of each public entity, based on their own needs.

What does the regulation say about non-working days in the private sector?

According to the Supreme decret published in December 2022 and endorsed by President Dina Boluarte, private sector workplaces may benefit from the provisions of a prior agreement between the employer and its workers, who must establish the way in which the recovery of the hours left from work will be made effective. labor. In the absence of agreement, the employer will decide.

Although this regulation is voluntary for this sector, according to the Mercer Marsh Peru survey, 40% of companies have considered granting this Friday, April 28 as a day of rest. The study also shows that 11% of the companies will give this date without the need for recovery, while 56% will deduct it from the days of vacation and 36% will request that it be recovered within the week.

Will I receive triple pay if I work on the non-business day of April 28, 2023?

It is necessary to specify that every employee who works on April 28, considered as a non-working day, will receive his payment as a normal day and not a triple remuneration, since this date is not considered in its entirety as a holiday. Only in the latter case, the payment that your employer must make you is applied three times: once for the holiday, another for the work done and a surcharge of 100%.

What is the difference between a holiday and a non-working day?

The holidays non-working days are established through the Legislative Decree No. 713 and are national in scope, while compensable non-working days are established by the Executive Power, based on particular considerations such as national security, tourism promotion. In addition, they are mandatory for the public sector.
