The Supervisory Agency for Private Investment in Telecommunications (Osiptel) declared partially founded the appeal filed by Telefónica del Perú against Resolution No. 130-2022-GG/OSIPTEL. Thus, through resolution No. 00069-2023-CD/OSIPTEL, the administrative responsibility of the operator was reaffirmed in more than three infractions against articles 17, 20 and 7 of the conditions of use. Therefore, the company must pay more than 150 UIT (S/767,250) of penalty fee.
Why was Telefónica fined?
In detail, the fine was modified from 50 UIT to 7.50 UIT for failing to comply with the provisions of the first paragraph of article 17 of the Conditions of Use of Public Telecommunications Services. In addition, the infraction for 35.80 UIT was confirmed for failing to comply with a light sanction typified against article 120. Finally, the fine of 113.20 UIT for a serious infringement typified in Article 7 of the Regulation of Inspection, Infractions and Sanctions.
In this line, it is specified that this resolution exhausts the administrative route, for which reason no appeal will be made through it.
