The Consumer Defense Commission of the Congress of the Republic unanimously approved the decision issued in bills 193/2021-CR, 555/2021-CR and 656/2021-CR which, through a substitute text, proposes turning Indecopi into a constitutionally autonomous body (OCA).
With 9 votes in favor, the ruling, which contains the initiatives of congresswomen Patricia Juárez, Adriana Tudela and Susel Paredes, proposes a constitutional reform that modifies article 101 and incorporates articles 65-A, 65-B and 65-C into the Political Constitution of Peru.
The new article 65-A raised by the Consumer Defense Commission seeks to resolve the “lack of real autonomy of Indecopi”, since by law it is currently attached to the Presidency of the Council of Ministers (PCM).
“The independence of competition defense agencies, such as Indecopi in Peru, is vital for them to operate objectively and technically. Years ago, the importance of establishing a solid constitutional framework that protects Indecopi from influences has been highlighted. external pressures and pressures from economic agents. However, the latter are not the only ones interested, because there are also political actors,” the working group reports.
It should be noted that the Constitution and Regulations Commission, since last year, also approved a favorable opinion based on it and with the contributions of various institutions.
As for the article 65-B, it is proposed that the election of the members of the new Board of Directors of Indecopi be carried out in no more than 60 days from the entry into force of its Organic Law. Likewise, with the article 65-C An evaluation committee of the members of this council will be formed, made up of the Ombudsman, the president of the Council of Ministers, the president of the SBS, the president of the BCRP, and the comptroller of the Republic.
“The benefits of declaring Indecopi as an OCA are many. The constitutionally recognized rights, which form an integral part of the defense of the social market economy model, will be protected by an autonomous body, freeing their interpretation and scope from private interests of the Executive Power”, the document reiterates.
