The Spanish Government, the unions and the employers have sat down again this Wednesday in the social dialogue table on labour reform, to which the Executive of Pedro Sánchez has come with a new document in which he raises the possibility that companies make temporary contracts to cover occasional activities for a maximum duration of 3 months, as reported by union sources.

The Government proposes that the temporary hiring is linked to very specific causes and that indefinite contracts are the ordinary when it comes to incorporating workers.

The temporary hiring will be justified as long as it is occasional and punctual, without exceeding three months, and the number of workers that may be incorporated through this contract will depend on the size of the company.

For cyclical campaigns, such as sales or Christmas in the case of commerce, the typology of discontinuous fixed, since these jobs are repeated periodically.

On the other hand, a job vacancy that is filled for more than five months with different temporary employees will be considered a structural post and the company must resort to a Indefinite contract.

In the case of replacement contractsThese must accommodate the term in which the person being covered returns.

However, the sources of the dialogue table remind that it is a proposal and that all the points on the hiring are still under negotiation.

Willingness for dialogue and agreement

The President of the Spanish Government, Pedro Sanchez, has assured that it addresses the reform of the labor market with “resounding availability” to reach an agreement with both the employer and the unions.

The Secretary General of CCOO, Unai Sordo, sees “difficult but not impossible” to reach an agreement on labor matters with the Spanish Confederation of Business Organizations (CEOE), since in the negotiation “there may be margins”.

“It is difficult because the current legislation of 2012 has made hiring precarious, made layoffs cheaper and has given companies opportunities to worsen working conditions and when one party is given so much power it is difficult for them to renounce it,” he added. the CCOO leader.

For his part, the president of the CEOE, Antonio Garamendi, has assured that it is possible to agree with the Spanish Government and the unions on the labor reform, although they have not joined the agreement on pensions.

“The negotiation is open, and each table is an independent table. Therefore, it is independent that in some tables we say yes and we can have an agreement and in others we say no (…) We are going to give it margin and space , we have a month ahead, “he stressed.

The new labor reform must be published in the Official State Gazette (BOE) before the end of the year, as part of the Executive’s commitment to Brussels to receive European funds.

The government, the employers and the unions will meet again on Friday.
