The National Institute for the Defense of Competition and the Protection of Intellectual Property (Indecopi) first sanctioned the Banco de Crédito del Perú (BCP) with S/113,701 (22.97 UIT) for not adopting the security measures that corresponds and allow 31 unrecognized purchases with a user’s credit card, in the city of Huaraz.
The Commission of the Regional Office of Indecopi in Ancash based in Chimbote considered that said bank violated article 19 of the Consumer Protection and Defense Code, which establishes that suppliers are responsible for the suitability and quality of the products and services offered. , that is, that there is a correspondence between what is offered and what is finally provided.
It was proven that the BCP allowed the processing of 31 consumptions charged to the complainant’s credit card, without taking into account that they did not correspond to their usual behavior of the user and that it is part of the security measures established in the sector standard.
It should be specified that the affected consumer had not used his card for almost two years and, before that, the highest consumption was for the amount of S/1,094.
BCP must return paid fees to the user
As a corrective measure, the commission ordered the bank to cancel the amount of S/68,962 from the credit card within a period not exceeding 15 business days from the day after notification of the resolution. to unrecognized operations, as well as interest, charges, commissions and other concepts charged to said card for the aforementioned operations.
Besides, must return to the complainant the total payment of the quotas that would have been carried out as a consequence of the 31 unrecognized consumptions, as well as to carry out the procedures for credit rectification before the Risk Center of the Superintendency of Banking, Insurance and AFP in case it had been reported.
