He Ministry of Transport and Communications (MTC), Through Directorial Resolution No. 005-2023-MTC/18, it approved the “Guidelines for the evaluation of the economic utility of the vehicle declared abandoned”. These determine, mainly, that the cars can be declared abandoned and fit for scrap if they are more than 15 years old and their value of damaged parts or violations exceeds their market value.
In this way, the application of Supreme Decree No. 016-2021-MTC is facilitated, which allows the scrapping of vehicles in a state of abandonment that, to date, are in the warehouses of the provincial municipalities, ATU, Police and Sutran.
Criteria
The MTC has prepared, according to the procedure established by the National Appraisal Regulation, the guidelines for the evaluation of abandoned or deposited automobiles.
In this document, it is specified that a vehicle is suitable for scrapping if it meets one of these characteristics: if it is older than 15 years, if the amount resulting from the assessment of the negative externalities generated by the car is greater than the value of market determined by the appraiser or if the amount of the analysis of infractions and/or defaults is greater than its valuation.
In this way, the entity makes a calculation with the transport externalities affected by congestion and accidents, as well as an analysis of infractions and/or non-compliance corresponding to firm sanctions from which it obtains a value that adds the amount of the fines, the cost for the rights of permanence in the deposit and the one associated with the coercive execution procedure.
“In this case, it is ensured that the owner of the vehicle will not collect the vehicle and that the costs generated (including financial fines and the costs of custody and coercive proceedings, if applicable) are higher than the market value, so the private value of the unit is negative”, can be read in the annex to the resolution.
