Yura was sanctioned together with Business Rationalization, both are part of Grupo Gloria. According to Indecopi, the cement company incurred in a position of dominance.
Cement manufacturing and trading company Yura and the freight forwarding company Business Rationalization (Raciemsa)both belonging to Glory Groupwere sanctioned by the Commission for the Defense of Free Competition of the National Institute for the Defense of Competition and the Protection of Intellectual Property (Indecopi) for committing one conduct of abuse of dominant position.
The two companies received the sanction in the first administrative instance. According to indecopithey committed abuse of domain positioning, since they prevented or hindered the commercialization of cement by their competitors in the market, between October 2014 and April 2019, in the southern regions of the country such as Arequipa, Cusco, Moquegua, Puno and Tacna, where Yura has more than 90% share of said product.
In this sense, the Commission of Indecopi Defense of Free Competition imposed the fine of 12,416.40 Tax Units (UIT), equivalent to more than S/60 million, to both mentioned companies. Likewise, nine Yura workers were sanctioned with a fine of 253.89 UIT, which represents S/1.2 million.
How did they hinder competition?
According to research by indecopithe cement company Yura implemented strategies that prevent other companies from selling cement in the market. To do this, they threatened or penalized the distributors that, in addition to Yura, offered other brands of cement. In the same way, racemsastopped scheduling transportation services to those carriers that moved competing cement.
These practices, according to the sanctioning institution, allowed Yura maintain the levels of its prices in the market, thus harming consumerssince they did not allow us to choose other brands of cement.
