EsSalud: Congress insistently approves the incorporation of CAS workers into the 728 regime

The Executive had observed that the entry of CAS workers to the private activity regime, directly and without competition, violates the principles of merit and equality in access to public functions, in addition to generating an imbalance in the sector’s budget.

With 111 votes in favor, the Plenary of the Congress of the Republic approved this Friday the insistence of the law that incorporates the labor regime of DL 728, Labor Productivity and Competitiveness Lawto the workers of the Social Security of Health of Peru – Essalud, immersed in the CAS regime with an indeterminate term contract.

As recalled, this device in favor of medical workers had received the approval of parliamentarians during the session of December 21, 2022. A week later, it was sent to the Executive for its promulgation, but on January 19 it was observed.

Congressman José Luna Gálvez, head of the Budget and General Account Commission of the Republic, said that the initiative seeks to do “justice” with the doctors of the CAS regime who do not have the benefits of other workers, despite having contributed to the emergency against COVID-19.

“The hiring of personnel in charge of providing benefits is within the purpose of the EsSalud funds, and therefore it is not affected by the intangibility of said funds; In the EsSalud budget, as of August 2022, 37% was allocated to personnel expenses, approximately 3.99 billion soles. Therefore, this observation is invalid,” signed the legislator of Podemos Peru.

One of the main challenges to the rule is that incorporating CAS workers into the 728 regime would generate an evident increase in public spending that would not have financing.
