Today, February 20, the period initially set by the Government of Spain to pay extraordinary taxes on banks and energy companies ends. Most of the companies affected by the new tax have decided to speed up the deadlines and will settle, beyond the general disagreement, this Monday 50% of the tax. The other 50% will have to be paid in September.

However, the entities will seek to be returned the amount they are going to pay. Thus, the eleven banks affected and the two main banking associations, the AEB and the CECA, have filed two contentious-administrative appeals before the National Court to challenge the ministerial order.

The banks have already drafted a claim against the new tax, which they will present to the courts just a few hours after paying it, alleging unconstitutionality, double taxation and incompatibility with their own regulations to which they are subject.

The law that regulates the tax provides that entities that in 2019 obtained more than 800 million between interest margin and net commissions must pay 4.8% between both concepts in 2022 and 2023.

The banks that meet this requirement are: BBVA, Santander, CaixaBank, Bankinter, Sabadell, Unicaja, Abanca, Kutxabank, Ibercaja, Cajamar and BNP Paribas. Small entities such as rural banks and some foreign banks are left out.
