The Ministry of Labor and Employment Promotion (PETM) published this Sunday, February 19, the last list of those who remain registered in the National Registry of Irregularly Dismissed Workers (RNTCI). This includes 13,530 former workers.
The people who are on the list, within a maximum period of 60 business days, must opt for one of the benefits provided in article 3 of Law No. 27803, Law that implements the recommendations derived from the commissions created by the Laws No. 27452 and No. 27586, in charge of reviewing the collective dismissals carried out in State companies subject to private investment promotion processes and in public sector entities and local governments.
In other words, in accordance with the regulation in question, they can choose to reinstate or relocate to work, early retirement, economic compensation or training and job retraining.
For it, must submit the ‘Benefit Election Request’ form before the Office of Attention to the Citizen and Documentary Management of the MTPE or the one that takes its place in the Directorates or Regional Managements of Labor and Promotion of Employment.
The documentation that proves the election of the benefit, in accordance with Law No. 27803, can be presented in simple copies, attaching an affidavit from the administrator about its authenticity, in accordance with the provisions of article 49 of the Single Ordered Text. of the General Administrative Procedure Law, approved by Supreme Decree No. 004-2019-JUS.
The legal provision published today in El Peruano also entrusts the General Directorate of Policies for the Promotion of Labor Formalization and Labor Inspection of the MTPE with the attention of communications that are presented within the framework of what is regulated in this ministerial resolution. As well as the General Directorate of Policies for the Promotion of Labor Formalization and Labor Inspection, the execution of the benefits, as appropriate, of those registered in the RNTCI, within the framework of Law No. 31218.
