The law that creates the regime for the rescheduling of social security contributions is formalized

Companies that have not paid the contributions of their workers in a timely manner, will be able to access a rescheduling until December 31, 2023

The Congress of the Republic made official this Friday, February 17, 2023 the Law No. 31690 that creates the scheme for the reprogramming of social security contributions of the private pension system for entities of the private sector. The measure was approved in the Legislature in the first week of January.

Therefore, the regulation published in El Peruano creates the regime for the rescheduling of contributions called REPRO AFP-PRIVADO, accrued until December 31, 2022, which were not paid on time by private sector entities. To this end, it indicates that these companies may request the rescheduling of their debt, submitting their application for foster care to the private pension fund administrators until December 31, 2023.

The debt subject to rescheduling is updated by applying the nominal profitability obtained in the Private Pension System determined by the Superintendency of Banking, Insurance and Private Pension Fund Administrators, in replacement of the fines and interest applied regularly.

It is added that the entities covered by the PRIVATE REPRO-AFP, which fail to comply with the total and timely payment of three (3) consecutive installments, will lose the benefits obtained. “If there is a judicial collection procedure in force, this will be suspended for the total amount of the debt received, as soon as the debtor proves the acceptance of the PRIVATE REPRO-AFP. The suspension of judicial collection will be without effect in the event that the entity received to the PRIVATE REPRO-AFP”, says the law.

Likewise, it is established that the duly updated debt, matter of foster care, can be divided for a maximum period of five years. In addition, the legal representatives of private sector entities that have applied to REPRO AFP-PRIVADO are civilly and criminally liable, as appropriate, for failure to pay in accordance with the provisions of this law.

Finally, it is specified that the Executive Power, through the Ministry of Economy and Finance, has a period of 90 days to issue the regulations of this law.
