Sunat: TC ruling discourages compliance with tax obligations

The entity has submitted a request for annulment of the sentence, since the payment of late interest would be reduced “substantially”.

The National Superintendence of Customs and Tax Administration (Sunat) reported that the ruling issued by the Constitutional Court (TC) sets precedent rules to substantially reduce the payment of default interest and tax debts in dispute.

“The Sunat Prosecutor’s Office has filed an annulment request against said sentence that would benefit the companies that delay and maintain millionaire debts with the State, through endless challenges,” said the entity.

In this way, the institution maintains that the ruling of the TC “disincentives voluntary and timely compliance with tax obligations”, affecting State resources, also promoting the prosecution of new cases.

Finally, Sunat specified that, in 2022, a record tax pressure was registered, the highest in the last 42 years, as a result of the entity’s actions to improve the levels of formalization and reduction of evasion rates.
