“Current labor regulations do not provide protection for those adults over 70 years of age who freely decide to continue working. Indeed, we have that article 57 of legislative decree 728 establishes that retirement is mandatory and automatic at 70 years of age, unless otherwise agreed,” said Sigrid Bazán, president of this parliamentary group.
According to Bazan, there are approximately 93,000 workers who are close to turning 70 years of age and, therefore, close to facing the possibility of losing their job. In addition, by 2024, the beneficiaries would be those who by 2021 were 67 years old, that is, 112,755 older adult employees, according to the INEI’s National Household Survey (Enaho).
The proposal states that, in order for the worker to be able to continue exercising his functions until the age of 75, it is necessary that there be a multidisciplinary medical study that verifies that the server is fit in his capacities, both physical and mental.
“Forced retirement becomes a form of age discrimination for us and affects the right to work,” stated the congresswoman Francis Paredes (Bloque Magisterial), author of one of the projects.
Parliamentarian Paredes recalled that Congress approved, last year, eliminating the maximum age limit for the exercise of university teaching in order to optimize the principle of equality of special protection and guarantee the right of workers of house teachers superiors.
