Sunat detected that taxpayers used bad checks to avoid collection of tax debts

The National Superintendence of Customs and Tax Administration (Sunat) reported that it has identified taxpayers who, continuously and systematically, used checks without financial backing to avoid collecting their tax debtswhich, in addition to harming tax revenues, constitutes a crime of tax fraud, therefore, it has already been denounced before the Public Ministry.

“The subjects denounced they made the payment of their tax debts with bad checks from another banktaking advantage of the fact that the accreditation of the availability of money is not carried out immediately due to the operation of the bank, seeking to delay and avoid, in some cases, the initiation of coercive collection actions,” the collecting entity detailed.

Although most tax payments are made through the electronic mediaduring 2022, 2% was made with checks.

To write a check, the person must ensure that they have money available in their checking account for the entire disbursement, unless they have authorization from the bank itself to overdraw. It is enough to present one that does not have funds to configure a crime, which must be reported to the SBS and the corresponding judicial instances, recalled the Sunat.

For the type of crime reported, The expected penalty is five to eight years of imprisonmentas well as a civil reparation to the State for the unpaid taxes and a possible temporary or permanent cancellation of the license to carry out economic activities.

What payment alternatives are there for taxpayers?

Taxpayers have at their disposal more efficient, effective and less expensive alternatives than checks to cancel their tax debt, such as virtual means of payment, a service that is currently the most widely used.

Thus, disbursements can be made in person at bank windows or virtually through the Sunat portal charged to a bank account, debit or credit card, or to the withdrawal account. Also through the bank’s website, mobile banking, the pagalo.pe mechanism. and the electronic wallet.
