The coercive collection procedures and judicial processes followed by the tax authority against the mypes would also be suspended, according to the proposal of congressman José Luna Gálvez.
the congressman Jose Luna Galvezfrom the parliamentary group Podemos Peru, proposes that a program of deferral and fractionation of tax obligations be established for up to 12 months for micro, small and medium-sized (mypes) companies that have been affected by the social upheaval at the national level. This situation began on December 7, 2022 after former President Pedro Castillo tried to carry out a coup.
Bill 4202 also states that coercive collection procedures and judicial processes followed by the tax authority against mypes are suspended for a period of six months from the validity of the norm.
It should be noted that although mypes make up 90% of the country’s business sector, at the end of 2021 more than 80% of these productive units were informal, according to ComexPerú.
“The benefit is translated in favor of micro, small and medium-sized companies affected by the social upheaval at the national level due to disturbance of peace or internal order, which may have greater liquidity by deferring or splitting the payment of the tax debt and being able to continue with their productive activity, not interrupting the payment chain”, specified in the document.
The initiative was presented last Wednesday, February 8, and has yet to pass the evaluation of the congressional committees in order to reach the plenary session and, subsequently, proceed to its debate and vote.
