World Cancer Day: workers have the right to leave to take cancer tests

In the event of testing for breast or cervical cancer, no refund of hours not worked will be required.

He Ministry of Labor and Employment Promotion (MTPE) recalls that all workers, both in the public and private sectors, have the right to request a license with pay per year to perform oncological examinations in a preventive way.

In accordance with Law No. 31479, which incorporates article 12 of the National Cancer Law (Law no. 31336), this permit will be of a compensable nature.

They are entitled to a compensable annual leave, for up to two business days, consecutive or not, to undergo their oncological preventive exams. The leave granted to the worker will be compensable with working hours that will be agreed with the employer.”indicates the norm.

In this way, the worker must previously submit to his employer or higher authority the medical order in which the tests to be carried out are indicated. After that, he must present the documents that prove that he was attended.

It is important to mention that in case tests are carried out for the breast cancer and cervixor, the workers they should not return the hours. As established by the Law for the Prevention of Cancer in Women and the Strengthening of Specialized Oncology Care (Law no. 31561), this license does not require compensation.

Employers and companies that do not comply with this rule would be committing a very serious infraction and will receive the respective sanction.
