Perupetro will implement prior consultation for the exploitation of Block 8

Conditions. Process must ensure that activity will be executed with the best business practice, as well as the performance of actions of decontaminationsay experts.

The Ministry of Energy and Mines (minem) temporarily delegated to Perupetro the competence to implement the prior consultation process for the exploitation of hydrocarbons from Block 8 located in the Loreto region.

The provision includes the stages corresponding to the preparatory meetings for the consultation plan, publicity of the legislative or administrative measure (third stage), information on the legislative or administrative measure (fourth stage), internal evaluation (fifth stage) and logistical support for the development of the dialogue stage.

To date, the production of the aforementioned batch is paralyzed and in the midst of a dispute between Perupetro and Pluspetrol Norte in Liquidation.

The prior consultation process will make it possible to find out if it is overlapping with the lands of the communities or if it will generate any impact on their rights, says César Gamboa, executive director of Law, Environment and Natural Resources (DAR). In addition, he adds that it is a necessary requirement to sign a new exploitation contract.

Aspects to consider

For his part, Mariano Castrodirector of the United for Forests Program, says that there are studies that show environmental liabilities of Block 8 “product of bad business practices that left health, the territory and the environment in a deficient state.”

The investigations to which he mentions are the supervisions and sanctions carried out by the Agency for Environmental Assessment and Enforcement (OEFA) and the independent Technical Study of the lot 8 (ETI). The latter, among his conclusions, highlights that “there is contamination in the fragile ecosystems of Block 8 because the oil activity is not carried out with the best practices.”

For this reason, Castro emphasizes that with the decision adopted by Perupetro three things must be ensured: 1) that it will be executed with the best business practice; 2) that it will contribute to the territorial development of the Amazonian peoples; and 3) that the decontamination and rehabilitation actions established by the OEFA and the ETI will be carried out.

Lots 202 and 203 will also go to prior consultation

Through Ministerial Resolution No. 041-2023-MINEM/DM posted yesterday too Perupetro was temporarily delegated the power to implement the prior consultation processes, corresponding to the draft supreme decrees that approve the signing of hydrocarbon exploration and exploitation contracts for blocks 202 and 203.
