Congress proposes to reduce fines for the fishing sector by up to 90%

Congressman Jorge Luis Flores Ancachi proposes to recover productive activity in the fishing sector and aquaculture through a new exceptional regime to reduce fines. Legislative initiative 4025 states that natural and legal persons who have sanctions imposed by the Ministry of Production they can benefit from a reduction of up to 90% of their total fines.

It is proposed that the reduction scale will be taking into account the following parameters: when the fine is up to 50 UIT, the reduction cannot be less than 90%; while when it is greater than 200 UIT, the decrease cannot be greater than 50%. In addition, the value of all fines must be added at the time the rule comes into force.

Another detail is that, if the final amount to be paid exceeds the value of a UIT, it can be divided into up to 12 monthly installments. While, Those who want to benefit from the rule will have 120 business days from its entry into force.

According to the proposal, Supreme Decree No. 007-2022-PRODUCE, which also reduced the fines by up to 90% and which was called the ‘fishing package’, was not enough for the great bulk of small fishermen to be able to benefit to the benefits of this measure.

“This law seeks that fishing agents can have greater liquidity and, therefore, recovery in productive activity as a result of the COVID-19 pandemic, natural or legal persons who have Sanctions of a fine in the contest period, sanctions of a fine contested in administrative or judicial proceedings and sanctions of a fine in coercive executioncan take advantage of the exceptional and temporary regime of reduction of fines ”, the document specifies.

The legislative proposal was presented on January 19 and must go through the evaluation of the congressional commissions before its debate and vote in plenary.
