Indecopi: companies are obliged to report restrictions on scheduled services

The National Institute for the Defense of Competition and the Protection of Intellectual Property (Indecopi) notified that, given the impossibility of providing their services for reasons of force majeure, the providers of any service are obliged to guarantee the rights of consumers.

In its capacity as governing body of the National Integrated Consumer Protection System, and in the midst of a scenario of demonstrations and mobilizations at the national level, Indecopi specified that the main right of consumers is to receive a service as expected.

“Companies and suppliers must adopt security and prevention measures in the services they offer during the protest situation,” said the regulatory body.

In the provision of transportation services, companies are obliged to keep passengers informed about the restrictions of scheduled services, as well as grant facilities for rescheduling and/or canceling the tickets purchased.

In this sense, companies must keep their service channels active at critical times in order to provide updated information, in addition to the complaints book.

For their part, tourist service companies must grant the facilities for postponement in the face of the situation, or guarantee the reimbursement of tickets or tourist packages.

“Indecopi will remain vigilant and continue to monitor the market to prevent the rights of citizens from being violated during their consumer relationships,” he said in a statement.

Indecopi has available the “Guide for consumers in emergency situations in Peru” with guidelines so that citizens know how to act and identify which institution they can go to to report problems and obtain a timely response in emergency situations.
