Law made official that will prevent artisanal fishermen from being investigated for incidental fishing

This Wednesday, January 18, the modification to Law 31622 was officially published in order to prevent artisanal fishermen from being investigated for incidental fishing. In this way, the controversy generated by this norm is put to an end. which basically seeks to establish stricter mechanisms to deal with the trafficking of marine and terrestrial species, since after its promulgation in November it was sought to repeal it.

Law 31673 modifies article 308-B of Law 31622 and adds the following precision: “Incidental catches of species and/or sizes other than those authorized, in any type of fishing and those that are in formalization processes, as long as they are carried out during permitted activities and areas, complying with the corresponding fishing regulatory standards”.

“The opportunity was also taken to include that shipowners who are in the process of formalization are neither investigated nor penalized for not having a fishing permit.” projection Percy Grandezlegal advisor to SPDA Marine Governance to this journal.

As Law 31622 was approved, it did not harm artisanal fishermen; however, there were legitimate concerns on their part, he added.

For this reason, it was specified that incidental fishing —when unauthorized species or sizes are caught— is exempt from the application of this law. “The opportunity was also taken to include that shipowners who are in the formalization process are neither investigated nor penalized for not having a fishing permit,” he stressed.
