The National Superintendency of Customs and Tax Administration (SUNAT) officially communicated that it obtained a favorable court ruling in the last instance. Telefonica del Peru went before the Fiscal Court and the Judiciary to avoid payment of the determination of the debt that, after inspection, had been established in favor of the Treasury, corresponding to the Income Tax for the years 2000 and 2001.
“The ruling was notified yesterday and issued by the Fifth Chamber of Transitory Constitutional and Social Law of the Supreme Court. This result is a consequence of the technical work of SUNAT in coordination with the entity’s Attorney General’s Office. This judicial resolution obliges Telefónica del Perú to pay around S/3,000 million,” the entity specified.
After several years in litigation, the authorities ruled in favor of the state entity. This way, the company is obliged to pay the largest fine in its history in our country. In the early hours of the day, it was made public, through an important fact reported to the Superintendence of the Stock Market (SMV), that the company said it had been notified of various rulings issued by the Supreme Court that resolve “in an unfavorable” processes followed with the Sunat.
The telecommunications company also specified to the newspaper El País that this sanction will have little impact on the company, since it already had a provision of 790 million euros in case they lose this process.
