Taxes in Lima and Callao will rise up to 15% this 2023

This year, excise taxes in 32 municipalities of metropolitan Lima and Callao will have an increase of between 3% and 15% compared to 2022. This is due to the adjustment in the Consumer Price Index and inflation, according to information from the Chamber of Commerce of Lima (CCL).

In this line, the districts that will increase their rates the most are Chorrillos and San Martín de Porres, since both will increase by 15%. They are followed by San Juan de Miraflores (10%), Ate (10%) and Mi Perú (7.05%). While the places that will not have any variation in their taxes are Cieneguilla, Lince and San Miguel.

“According to the Municipal Tax Law, no later than December 31 of each year, The municipalities of Lima must publish their respective ordinances in the official newspaper El Peruano, in which the effective costs demanded by the public service are stated. according to the number of taxpayers in their respective jurisdictions,” added Álvaro Gálvez, manager of the CCL Legal Center.

It should be noted that last year inflation in metropolitan Lima closed at 8.46%, one of the highest rates recorded in the last 26 years.

Arbitration and its reasons

The excise are the fees that are collected to cover the maintenance of parks and gardens, public cleaning and the work of the serenity. Within this framework, each municipality is entitled to charge for these services as long as they are in favor of the community, David Bravo, a tax attorney, told La República.

Likewise, for any increase in their prices to be legal, there must be a municipal ordinance, ratified, in this case, by the Provincial Municipality of Lima and later published in the newspaper El Peruano.

“The municipal ordinances that create these taxes or that intend to increase them have to have a cost structure, where all those elements that are part of it are detailed, as well as the expenses related to the leaking of services”, explained the specialist.

In addition, they must also refer to the parameters pre-established by the Constitutional Court. Likewise, according to the SAT, citizens can make the payment of their excise taxes in quarterly installments or in cash. If it is done directly, before the expiration of the quarter, a discount of 5% corresponds.
