The Contentious-Administrative Court number 3 of Donostia-San Sebastián has recognized the right of three carriers to recover the money they paid as tolls for fees improperly collected by the Gipuzkoa Provincial Council.
As confirmed by foral sources, the amount that the Provincial Council must repay these truckers is around €10,000 since legally it is not possible to appeal the ruling, which is final as it is an amount of less than 30,000 euros.
The cited sources have explained that the compensation to be paid is linked to the collection of tolls contemplated in the regional regulations approved by the General Assemblies of Gipuzkoa in 2016 and 2018 for the collection of tolls from carriers on high-capacity roads. of the territory, which were annulled by the courts.
The decision adopted now by the aforementioned Contentious-Administrative Court has no influence on current toll collection on these roads, since it is governed by a third foral regulation approved in December 2021 by the Foral Parliament.
However, the matter is being analyzed by the legal services of the Diputación since the casuistry is “quite broad”.
