In September of this year, the Congress of the republic enacted Law No. 31572, which regulates the telecommuting in the public and private sectors, replacing the old regulations issued in 2013 and remote work, created within the framework of the pandemic. However, it was still pending for the Executive Power to issue the regulations so that the new legislation can be implemented.
Thus, during the last week, the Ministry of Labor and Employment Promotion (MTPE) pre-published the draft regulation, in order to receive suggestions, comments or recommendations from workers, or their respective organizations, from public or private entities and of the general public, during a period of 10 calendar days.
In detail, within the proposal of the PETM Clarifications are made regarding the provision of technological equipment, Internet access service and compensation of expenses that involve teleworking.
Who assumes the costs of internet and electricity from teleworking?
According to the proposal of the Executive Branch, it is mentioned that although by prior agreement, the worker can provide their own equipment and the Internet access service, applying compensation in their favor for such effects, “the provision of these does not imply, under any circumstances, that the teleworker assumes all the expenses related to the equipment, tools and means related to the development of their work activityhe”.
Thus, in the case of equipment provided by the teleworker, compensation for said expense would be made based on the value of the asset, for which the characteristics of this and its value in the market can be taken as a reference. The same will happen in the case of internet service and electricity, in which the refund is made based on the minimum necessary cost values.
