“I calculate that, between Monday or Tuesday, the criminal execution judge would already be ordering the INPE (National Penitentiary Institute) to release him,” Nakazaki told reporters on Thursday.

The lawyer explained that the TC has to officiate its resolution to the supreme criminal execution judge, who must abide by the decision of the country’s highest constitutional body and “give the release order.”

The TC confirmed this Thursday that the casting vote of its president, Augusto Ferrero, decided the annulment of the judicial resolution that suspended the pardon granted in 2017 to Fujimori, after the vote on the “habeas corpus” appeal requested by that measure was tied with three votes in favor and three against.

Ferrero used his decision-making vote, known in legal circles as “quality vote” or “double vote”, and also had the favorable votes of José Luis Sardón and Ernesto Blume, who was the speaker who raised the acceptance of the appeal, while Marianella Ledesma, Eloy Espinosa-Saldaña and Manuel Miranda opposed.

The TC remarked that the sentence that declares the lawsuit founded “restore the effects of the supreme resolution 281-2017-JUS, of December 24, 2017, which granted the humanitarian pardon to the plaintiff, and orders his freedom” and that the votes of the magistrates “will be published on the institutional web portal and will be notified in due course.”

The pardon is being investigated by the courts, since the Prosecutor’s Office considers that it was the product of a negotiation between Kuczynski and Fujimori’s youngest son, Kenji, who was a congressman at the time, so that Fujimorist legislators would vote against a request for the dismissal of Fujimori. then president.

Supporters of the former president began to arrive at the prison in the Ate district, in eastern Lima, where Fujimori is being held, while social and civil groups that reject his release called for a mobilization through the historic center of Lima under the slogan “Pardon is insult.” (I)
