Olga Khomenko, 37, violated a court order by taking her daughter to kyiv in 2017 due to an “abusive marriage” but was saved from jail in a landmark ruling on Friday, The Sun reported.

The woman pleaded guilty to kidnapping the girl and faced up to five years behind bars. She was given a two-year suspended sentence.

Now the court granted Khomenko 72 hours of bail to travel to Ukraine, but he only made it as far as the Polish border before having to return to meet the time limit and his passport was withheld.

Judge Michael Kay said: “The criminal justice system has to have humanity” and ordered the immediate surrender of her passport and for her to leave the UK and go to Poland.
