The United States eliminates the Trump rule that expelled unaccompanied migrant children

The United States Centers for Disease Control (CDC) completely eliminated the controversial rule on Friday imposed during the government of donald trump (2017-2021) that expelled unaccompanied migrant minors who arrived at the border.

The current government, headed by Joe Biden, it no longer applied this rule with respect to minors –it does continue to expel adultshowever–, but a judicial resolution was going to force the Administration to reapply it as of midnight this Friday if the norm was not modified.

Thus, just before the limit was met, The CDC issued a statement reporting the removal of the rule regarding unaccompanied minors.

The reason why this rule – known as Title 42 – was issued by a health agency like the CDC is that it was justified as an extraordinary measure to protect Americans during the COVID-19 pandemicconsidering that immigrants arriving at the border could be carriers of the virus.

With its application, the possibility of requesting asylum was automatically denied to those who arrived at the border between Mexico and the United States.

“The expulsion of non-citizen and unaccompanied minors not justified as a public health protection measure”, the CDC indicated in its statement.

The Biden Administration does, however, maintain Title 42 for the expulsion of adults who arrive at the border and minors accompanied by their families.

Title 42 has been in effect since the start of the pandemic in March 2020.

After learning of the resolution, a group of Democratic senators issued a statement in which they said they felt “deeply disappointed” by the decision of the Biden Administration to keep Title 42 in force. However, they admitted that preventing the removal of unaccompanied children was “the right decision”.

The statement was signed by the leader of the Democratic majority in the Senate, Chuck Schumer, and Senators Cory Booker, Álex Padilla and Bob Menéndez. (I)
