The Court of Justice of the European Union (CJEU) will rule on September 26 on the appeal filed by the former president of Catalonia Carles Puigdemont and his former minister Toni Comin against the European Parliament for not initially recognising them as MEPs nor the immunity associated with obtaining seats for JxCat in the European elections of May 2019.
The ruling will be read at 9:30 a.m. on Thursday, September 26 at the Court based in LuxembourgEuropean sources have informed Europa Press, in a ruling that will come two months after the European Parliament is formed on July 16 following the elections of June 9.
Comín was elected MEP again on this occasion but his seat is vacant because the list of MEPs communicated by The Central Electoral Board for the European Parliament does not include his name as he did not attend the event in the Congress of Deputies to abide by the Constitution. Last April, the opinion of the EU Advocate General – which is not binding on the CJEU but sets the line of judgments in the vast majority of cases – recommended supporting Puigdemont and Comín in their appeal.
The opinion of the European lawyer thus contradicted a first instance ruling by the European Court of Justice in July 2022 in which it was considered that the then president of the European Parliament, the ‘popular’ Antonio Tajanilimited itself to taking note of the legal situation of the two pro-independence politicianswhose names did not appear on the list of elected MEPs notified by the Central Electoral Commission.
