The Supreme Court of the United States has authorized Idaho doctors to perform emergency abortions in case of a serious health risk for the pregnant woman, in a ruling that does not go into the substance of the issue but that allows this type of medical practices at least temporarily.

The decision was made official on Thursday, although the court had already mistakenly published the text on its website on Wednesday. It establishes that the Supreme Court, by six votes to three, first rejects an appeal presented by the state of Idaho and several Republican congressmen.

It is therefore not a final ruling of national application, but rather The High Court’s decision means going back to another January ruling by a lower federal courtunder which doctors can perform abortions to protect the mother’s health.

Idaho law is one of the most restrictive in the United States regarding abortion. Punishes those who carry out this practice with sentences of up to five years in prison, with the only exception when the life of the pregnant woman is in dangerwhich forces many of them to wait days or move to another state.

The president of the United States, Joe Biden, has celebrated the Supreme Court’s ruling, with a statement in which he stated that “no woman should be denied assistance, having to wait until they are close to death or escape from their state just to get the medical care he needs.

Biden has pointed out that “this is exactly what is happening in some states” since the Supreme Court, controlled by conservative justices, reversed in 2022 the historic ruling that enshrined abortion as a right at the federal level. In this sense, the president has denounced the “extreme and dangerous agenda” of the Republicans on this matter and has promised that his Government will defend women’s rights. “We will continue fighting to restore the protections of ‘Roe versus Wade’ in federal law,” she stressed, although to do so she needs the collaboration of Congress.
