The US issues an order to legalize undocumented immigrants: will it benefit Peruvians?

This week a new opportunity opened to legalize millions of people who live irregularly in the USA thanks to an executive order issued by the president’s government Joe Biden, known as Parole in place. Will it benefit Peruvians? What does it consist of?

The announcement was made this Tuesday, June 18, and will allow for the regularization of more than half a million migrants who live in that country without legal status.

Who does it favor?

“The people who will benefit from this measure are those married to American citizens (before June 17, 2024) and who have also lived in the United States for at least 10 years,” Antoinette Carrillo Durand, a lawyer specialized in immigration laws in the United States, explained to Andina.

The minor children of these couples will also be protected by this legal figure that protects them from deportation.

“Students or so-called ‘dreamers‘, who must have graduated from educational institutions recognized by the United States”he added.

Thanks to Parole in Place (PIP), they will be able to access a legal job offer with a US employer to fulfill functions with topics related to what they have studied.

“This is very good because with this work permit, they will have legal status and later the same employer can ask them to become residents.”

What is the procedure like?

Parole in place or current parole is a permit for which you apply and the granting of which is discretionary.

Immigrants must submit an application, which will be evaluated by the authorities of USA in accordance with the established parameters: only those who have married Americans and reside in American territory for at least 10 years will be able to participate.

“Once the application is approved and they obtain parole in place, immigrants will only be able to process the work permit and, in parallel, they will be able to apply for residency within a period of three years,” Carrillo Durand said.

The biggest advantage of this order issued by the president Biden is that illegal people in the United States will no longer have to leave the country to apply for residency.

“Let us remember that there is a ten-year punishment for people who lived more than a year illegally in the United States. Typically, people have to leave the country to access residency. With this executive order it will not be necessary for immigrants to leave,” the lawyer highlighted.

Will it benefit Peruvians?

The immigration measure does not make any distinction between nationalities, it only focuses on those who meet the aforementioned requirements and have not committed crimes in that country.

“The person must be theeligible. That is, they must not have a criminal record, be a risk to national security, or have committed fraud. In addition to “meeting the positive requirements, it must be admissible,” highlighted Antoinette Carrillo.

The specialist commented that thousands of illegal people in USA are interested in achieving this new legal status, including many Peruvians.

“At this moment, the United States has a very large colony of Dominicans and Venezuelans, also Peruvians. This rule will benefit all nationalities. A change of this nature has not been seen since, more or less, 1997″, added.
