The Supreme Court of Brazil annulled this Tuesday the decisions made by a regional court against Marcelo Odebrecht for which he ended up convicted of corruption in the scope of the operation ‘Lava Jato’official sources reported.
The investigation, ordered by Judge José Antonio Días Tofolli, does not cover the decisions derived from the agreement signed by the former president and heir of the Odebrecht group, in which he admitted his guilt and betrayed his accomplices in exchange for judicial benefits.
In addition to annulling the decisions made by the Thirteenth Federal Court of Curitiba, the magistrate also ordered the suspension of all criminal proceedings opened against the businessman.
According to Dias Toffoli, some members of the ‘Lava Jato’ operation “adopted arbitrary measures in the conduct of the processes against the businessman” acting with partiality and outside their sphere of competence.
The magistrate’s decision responded to a request from Marcelo Odebrecht’s defense under the premise that his case was similar to that of other defendants in the ‘Lava Jato’ operation whose cases were annulled due to irregularities in the investigations.
In September of last year, the same judge annulled all the evidence obtained through collaboration agreements with the construction company Odebrecht, which affected several politicians and businessmen from Brazil and other countries within the framework of the so-called ‘Lava Jato’ operation.
That decision responded to a request made by the defense of the president of Brazil, Luiz Inácio Lula da Silva, who spent 580 days in prison convicted of corruption and money laundering in a process that was later annulled and that was based in part on evidence offered by Odebrecht.
Most of the decisions annulled this Tuesday against Marcelo Odebrecht were issued by the then Thirteenth Judge of Curitiba, Sergio Moro, author of the sentences against Lula and who later was Minister of Justice in the Government of the far-right Jair Bolsonaro (2019-2022). .
