Changes are coming in the tobacco trade. New markings needed

The Prime Minister’s Office informed about changes in the Track&Trace system. So far, EU law covered only cigarettes and tobacco for rolling them. Now it will also cover other tobacco products. What does this mean for entrepreneurs running retail stores?

The government adopted a draft amendment to the Act on health protection against the consequences of the use of tobacco and tobacco products. As a result, new markings will appear on the packaging of products such as chewing tobacco or snuff. Shop owners selling these products will have to remember to register in the EU system.

The decision of the Council of Ministers results from the planned expansion of the EU System for Tracking the Movement and Origin of Tobacco Products (Track&Trace). Its aim is to combat the illegal trade in tobacco products and protect public health. Related activities include marking packaging with a unique identifier and recording the trade in tobacco products.

So far, the EU Track&Trace system only applied to cigarettes and roll-your-own tobacco. However, from May 20 this year, it will also be extended to include all non-excise tobacco products, such as: snuff, cigars, cigarillos, and chewing tobacco.

The law will also apply in Poland. What does this mean for entrepreneurs?

“The project adapts Polish law to EU regulations on the production, presentation and sale of tobacco products. It concerns the possibility of using special security elements placed on the packaging of tobacco products that are not excise products (e.g. chewing tobacco, nasal tobacco)” – we read in statement from the Prime Minister’s Office.

At the same time, it will not be possible to use security measures in the form of excise stamps on these products. Therefore, it is necessary to use other safeguards, which will be analogous to those for tobacco products sold in free zones.

How does this affect entrepreneurs? By law, all entities involved in the trade in tobacco products must be registered in the Track&Trace system. This also applies to individual retail outlets.
