Donald Trump will be able to appear on all ballots for the United States elections. The Supreme Court unanimously decided this Monday that the former president has the right to appear on the Colorado primary ballots, scheduled for March 5. Colorado is one of the 15 states voting this Tuesday.
The Colorado Supreme Court had ruled in December that Trump was ineligible to seek or hold office because of Section 3 of the 14th Amendment, adopted after the Civil War, which prohibits anyone from holding office who, after swearing to support the Constitution, had participated “in an insurrection or rebellion against it, or given aid or comfort to its enemies.”
The nine justices of the Supreme Court, against that decision, have determined that “the responsibility for applying section 3 against candidates and federal positions depends on Congress and not on the states.”
